Terms of Service

1. Acceptance of Terms

By accessing or using Triftt (the “Service”), you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Triftt provides budgeting tools that help you track spending by category, monitor weekly progress, and receive SMS reminders. The Service includes a web application and related APIs. Certain features connect to third‑party services such as Clerk (authentication), Plaid (financial data connections), Stripe (billing), Twilio (SMS), and logo providers.

3. Eligibility and Accounts

• You must be at least 13 years old to use the Service.
• You are responsible for safeguarding your account and promptly notifying us of any unauthorized use.
• You authorize us to use third‑party providers to verify your identity or phone number where applicable.

4. Financial Connections via Plaid

When you connect financial accounts, you authorize Triftt and Plaid to access your account information and transactions as described in their terms and privacy policies. Triftt does not receive or store your bank credentials. Access tokens are stored securely and used to sync transactions and account metadata to provide the Service.

5. Subscriptions, Trials, and Billing

• Paid plans are billed via Stripe and renew automatically until canceled.
• Trials, if offered, convert to paid unless you cancel before the trial ends.
• You may cancel at any time; access continues until the end of the current billing period.
• Fees are generally non‑refundable except where required by law. Contact support for billing issues.

6. Acceptable Use

• Do not misuse the Service, attempt to breach security, or interfere with other users.
• Do not use the Service to transmit unlawful, harmful, or infringing content.
• Do not reverse engineer or attempt to access data beyond your authorized scope.

7. Intellectual Property

Triftt owns all rights in the Service and its content, excluding third‑party marks and content owned by their respective holders. You may use the Service only as permitted by these Terms.

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and safeguard your information.

9. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non‑infringement. Triftt does not provide financial, legal, or tax advice. Insights and categories are for informational purposes only.

10. Limitation of Liability

To the fullest extent permitted by law, Triftt and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of the Service.

11. Indemnification

You agree to indemnify and hold Triftt and its affiliates harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for conduct that we believe violates these Terms or is otherwise harmful. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately, but certain sections (e.g., Intellectual Property, Disclaimers, Limitation of Liability) will survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, U.S.A., without regard to conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts located in California, and you consent to jurisdiction and venue there.

14. Changes to the Service or Terms

We may modify the Service and update these Terms from time to time. We will post updates and change the “Last updated” date. Material changes will be communicated with additional notice as appropriate. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
